Banner Health has agreed to pay $6 million to resolve class action claims surrounding a 2016 data breach which compromised sensitive information from millions of patients.
The settlement benefits individuals who received a notice from Banner Health that their information may have been compromised in the 2016 data breach.
The Banner Health class action lawsuit claimed that around 2.6 million of the health system’s patients were affected by a data breach in 2016.
Hackers reportedly gained access to Banner Health’s systems and downloaded “massive quantities of information.” This allegedly included personal identifying information, healthcare information and credit information.
The Banner Health class action claimed that patients suffered real injuries, including fraud and identity theft. The plaintiffs also alleged that Banner failed to inform patients about the breach with sufficient detail.
Banner Health has not admitted to any wrongdoing but agreed to resolve the claims against them with a $6 million class action settlement. In addition to paying into the multi-million dollar fund, the company will reportedly make improvements to their cybersecurity system.
The settlement offers compensation for time spent, expenses, and losses which resulted from the data breach. Ordinary payments are capped at $500 while extraordinary payments could reach $10,000. All Class Members will be able to receive two years of credit monitoring from Banner Health.
In order to make a claim for expenses, losses or over three hours of spent time, Class Members must provide documentation.
To benefit from this settlement, Class Members have to submit a valid claim form by Feb. 9, 2021.
The deadline for exclusion and objection is April 10, 2020. The final approval hearing for the Banner Health class action settlement is April 21, 2020.
Who’s Eligible
Individuals who received a notice from Banner Health that their information may have been compromised in a data breach that occurred in June and July of 2016.
Potential Award
There are three forms of compensation available under the Banner Health class action settlement:
- Ordinary Cash Reimbursement: Cash payment for up to three hours of undocumented lost time and/or additional documented expenses or losses of up to $500 per Class Member;
- Extraordinary Cash Reimbursement: Cash payment for up to 15 additional hours of documented time and/or additional expenses or losses of up to $10,000 per Class Member;
- Two Years of Credit Monitoring: Including $1 million in identity theft coverage.
Proof of Purchase
Documentation of time (more than three hours) spent handling the security incident and documentation of any expenses or losses incurred as a result of the breach.

Since the hackers.accessed the information on my 2nd surgery and used my records to claim multiple insurance claims and I registered why have I not received anything. The lawyers that are receiving the 2.9 million are fully aware of my cases. Or do they more than us.
