Current and former employees of Roadrunner Transportation Systems may be eligible to claim up to $5,000 from a class action settlement over a 2018 data breach.
All current and former Roadrunner employees whose human resources information was compromised during the data breach between April and May 2018 may be included in the Class.
The data breach exposed employees’ names, addresses, Social Security numbers, birthdates, payroll information, and other personal data.
Claims are divided into two types.
Claim A includes compensation for “ordinary” losses, such as costs related to credit monitoring or identity theft insurance purchased directly by the claimant, as long as the claimant can attest the product was purchased primarily as a result of the breach; costs related to requesting a credit report or freeze associated with the breach; lost time of at least one hour and up to three hours, at a rate of $20 per hour, as long as documentation is provided showing the time was related to the data breach; and incidental expenses related to the breach, such as postage or long-distance phone charges.
Claim B includes compensation for extraordinary losses, such as those associated with identity theft or fraud, or other misuse of personal information. These claims must include documentation of the amount of the losses.
The losses must not have been reimbursed already and must plausibly be a result of the data breach.
Claim B claimants may seek reimbursement of up to 10 hours of lost time at a rate of $25 per hour for time spent dealing with issues related to the breach.
Before they are eligible for an extraordinary losses payment, claimants who previously signed up for AllClear or Kroll identity theft protection services offered by Roadrunner must submit a claim to AllClear or Kroll and have that claim exhausted or denied.
The maximum payout possible for Claim A claimants is $250, while the maximum for Claim B claimants is $5,000.
Class Members also may sign up for 24 months of Experian IndentiyWorks identity theft protection beyond the Kroll or AllClear protection. Class Members will have a year form the date the activation codes are mailed to activate the additional monitoring.
The deadlines for consumers to object to or exclude themselves from the settlement have passed.
The deadline to file a claim is March 22, 2021.
