Over $9 million has been secured in a class action settlement, ending litigation over an alleged Bosch emissions defeat device used in certain Volkswagen (VW), Porsche, and Audi vehicles.
Individuals who owned diesel-powered vehicles with a Bosch defeat device may qualify, including:
- Those who owned or leased a 2014-2016 Audi A6, A7, A8, A8L or Q5, a 2009-2015 Audi Q7, a 2013-2016 Porsche Cayenne or a 2009 to 2016 Volkswagen Touareg, as of Nov. 2, 2015
- Those who owned or leased a 2009-2015 VW Jetta, a 2009 VW Jetta Wagon, a 2010-2013 or 2015 VW Golf, a 2012-2015 Passat, a 2010-2014 VW Golf Wagon, a 2015 VW Golf Sportswagon or a 2010-2013 or 2014 Audi A3 as of Sept. 18, 2015.
Class Action Lawsuit Alleges Emissions Scandal
Bosch was accused of designing and manufacturing an emissions cheating device that was used in certain diesel-powered vehicles. According to the class action lawsuit, the Bosch emissions defeat device would allow vehicles to pass emissions testing despite emitting higher than permitted levels of pollutants.
According to the complaint, the Bosch emissions device could sense when vehicles were being tested and ensured that they would pass the test. However, in real-world conditions, alleged the emissions class action lawsuit, the vehicles would release higher levels of toxins, including nitric oxide, a pollutant that causes acid rain and has been linked to health problems.
The plaintiffs in the Bosch emissions class action lawsuit contended that they and other owners and lessees paid a premium for the vehicles, specifically because they were diesel-powered and they thought they would be more efficient than conventionally powered engines.
Bosch Pays Up to End Emissions Class Action Lawsuit
The Bosch emissions class action lawsuit was first certified in 2018; however, the Class definition was later modified. Then, though Bosch refused to admit any wrongdoing, it agreed to pay $9.27 million to end the litigation. The class action settlement was approved in October of 2020.
Class Members may have already received benefits under several other emissions cheating class action settlements. Specifically, those with claims involving 2009 through 2016 Volkswagen, Audi, or Porsche 2l or 3L vehicles.
Under the terms of the settlement, four sets of Class Members may receive benefits. The Classes are determined based on whether the individual owned a “2L” or “3L” device.
The following are classified as 2L vehicles:
- 2009-2015 Volkswagen Jetta
- 2009 Volkswagen Jetta Wagon
- 2010-2013 and 2015 Volkswagen Golf
- 2012-2015 Volkswagen Passat
- 2013-2015 Volkswagen Beetle
- 2010-2014 Volkswagen Golf Wagon
- 2015 Volkswagen Golf Sportswagon
- 2010-2013 and 2015 Audi A3
The following are classified as 3L vehicles:
- 2014-2016 Audi A6
- 2014-2016 Audi A7
- 2014-2016 Audi A8
- 2014-2016 Audi A8L
- 2014-2016 Audi Q5
- 2009-2015 Audi Q7
- 2013-2016 Porsche Cayenne
- 2009-2016 Volkswagen Touareg
Class Members who leased a 3L Generation 2 Volkswagen, Audi, or Porsche vehicles may be able to claim an extra payment of $1,000 if they received lessee benefits under the terms of a previous settlement.
Additionally, those who owned a 2L Volkswagen or Audi vehicles as of Sept. 18, 2015, but sold before Jan. 4, 2017, the pre-approval notice date of another settlement, can claim an additional $750 payment.
Class Members who owned 3L Volkswagen, Audi, or Porsche vehicles as of Nov. 2, 2015, but sold before pre-approval of a previous settlement agreement, may be able to claim an additional $2,500.
These Class Members do not need to submit a Claim Form. Payments will be automatically sent and should be received by Class Members by May 8, 2021.
Finally, individuals who made a claim for a Buyback or Buyback with Trade-In under a separate settlement and were unable to transfer a portion of their warranty coverage may be able to claim up to $500.
Under the terms of the emissions class action settlement, Claim Forms only need to be submitted by Class Members seeking extended warranty benefits. These Claim Forms are due by April 8, 2021.
Class Members who have moved since receiving benefits under a previous settlement should update their address with the settlement administrator to ensure they receive their payment.
The deadline for Class Members to exclude themselves or object to the Bosch emissions class action settlement has already passed. An approval hearing was held Aug. 28. 2020.
Who’s Eligible
Those who owned or leased a diesel-powered vehicle with a Bosch device, including:
- a 2014-2016 Audi A6, A7, A8, A8L or Q5, a 2009-2015 Audi Q7, a 2013-2016 Porsche Cayenne or a 2009 to 2016 Volkswagen Touareg, as of Nov. 2, 2015
- a 2009-2015 VW Jetta, a 2009 VW Jetta Wagon, a 2010-2013 or 2015 VW Golf, a 2012-2015 Passat, a 2010-2014 VW Golf Wagon, a 2015 VW Golf Sportswagon or a 2010-2013 or 2014 Audi A3 as of Sept. 18, 2015.
Potential Award
Varies.
- Certain Class Members will receive direct payments of up to $2,500 per vehicle
- Class Members who make an extended warranty claim will receive up to $500 per claim
Proof of Purchase
Extended warranty claims must include either a Claim ID number or vehicle information, such as VIN and information about the extended warranty.

I purchased brand new from VW dealer a 2013 diesel passat my daughter was born with an environmental heart in 2012
I really felt I was helping the planet
Slap in the face big guys caught cheating with little penalty
