Hanna Andersson and Salesforce have agreed to pay $400,000 to resolve a class action lawsuit filed over a data breach that allegedly compromised the information of more than 200,000 Hanna Andersson customers.

Anyone who lives in the United States and made purchases on the Hanna website between Sept. 16, 2019, and Nov. 11, 2019, is eligible to make a claim in the settlement.

Class Members potentially affected by the Salesforce data breach will receive payments in an amount to be determined by the number of people who file valid claims.

Every Class Member is eligible for a Basic Award of up to $500, regardless of whether they were subject to any unauthorized charges on a payment card used to make a Hanna Andersson purchase.

The average payout is expected to be about $38, according to the settlement website.

However, some Class Members could receive payments of up to $5,000 in extraordinary cases such as fraud or rampant identity theft, the settlement agreement said.

Class Members who experienced unauthorized charges on their payment card between Sept. 16, 2019, and May 10, 2020, and believe those charges were a result of the Salesforce data breach are entitled to seek a Reimbursement Award of up to $5,000 for the unauthorized charges, up to three hours of lost time spent dealing with the charges or data breach at a rate of $20 per hour, and certain out-of-pocket expenses related to the data breach.

According to the settlement website, those wishing to seek a Reimbursement Award must first exhaust all available credit monitoring insurance and identity theft insurance.

The Salesforce data breach settlement also provides non-monetary relief.

Under the terms of the settlement, Hanna Andersson is required to implement stricter cybersecurity protocols, such as hiring additional information technology personnel, enabling multifactor account authentication, and conducting a risk assessment.

The Salesforce data breach class action lawsuit had alleged Salesforce and Hanna Andersson had failed to protect the plaintiff’s and Class Members’ information in a data breach in September and November 2019.

The breach allegedly involved hackers gaining access to customer information such as payment card information and billing addresses.

According to the plaintiff, Salesforce and Hanna Andersson failed in both preventing and detecting the breach, allowing the hackers to have unauthorized access for nearly three months.

Even after the Salesforce data breach was detected, the class action lawsuit claimed, customers were not informed of the incident until Jan. 15, 2020, costing the affected customers time in which they could have been mitigating the data breach’s effects, such as identity theft or fraud.

The class action lawsuit formally accused Hanna Andersson and Salesforce of violating the California Unfair Competition Law and the California Consumer Privacy Act.

A final hearing in the case is scheduled for June 17, 2021.

The deadline to file a claim in, object to, or opt out of the Salesforce settlement is April 28, 2021.
