Grand Celebration cruise ship crew members have reached a $875,000 settlement with Classica Cruise Operator Ltd.
A class action lawsuit alleged the defendants failed to pay severance and some Grand Celebration cruise ship crew members’ wages under their employment contracts for jobs the defendants assigned them.
All seafarer employees who were physically aboard the Grand Celebration cruise ship for at least one day between March 18, 2020, and Aug. 20, 2020, and were either terminated such that severance was due under their employment contract or were employed and performed a designated job at the defendants’ request are eligible to seek compensation through the settlement.
Deck and engine employees, independent contractors, and Classica Cruise corporate officers or corporate directors are not eligible to make a claim.
Class Members who file a valid claim will receive their contractual basic wages, according to the settlement website.
After court costs and other expenses are paid from the settlement fund, the remainder will be used to pay Class Members.
Claimants will be eligible for two types of payment.
- Wage Claim Type 1 claimants will receive two months of crewmember wages at the rate of pay established in their employment contract in effect as of March 18, 2020. The payment amount will be based on the salary on the contract for each approved claim.Â
- Wage Claim Type 2 claimants will receive $1,000 for each approved claim for any and all work performed on the defendants’ vessels during the Claims Period.
Classica Cruise denies all allegations of wrongdoing and has not been found at fault in court. However, it has agreed to a settlement in order to avoid the costs and burden of ongoing litigation.
A final approval hearing in the Grand Celebration cruise ship settlement is scheduled for May 12, 2021.
Those who would like to object to or be excluded from the settlement must do so by April 12, 2021.
Claim forms are available for download on the documents page of the settlement website. The deadline to submit a claim form is May 6, 2021.
