TikTok Inc. has agreed to pay $1.1 million to resolve claims the app collected children’s personal information without parental consent.

If approved, the settlement would benefit all people who registered for or used TikTok, or its predecessor Musical.ly, while under the age of 13. The settlement would also benefit these individuals’ parents.

Plaintiffs Sherri LeShore and Laura Lopez filed their TikTok class action lawsuit on behalf of their minor children in December 2019, alleging that the video app unlawfully gathers data from users under the age of 13.

Information gathered by the app reportedly included email addresses, phone numbers, full names, and any information the user included in their TikTok profile.

The plaintiffs argued that this data collection violated various federal and state laws including the Children’s Online Privacy Protection Act (COPPA).

The $1.1 million TikTok class action settlement was submitted by the plaintiffs to the court and received preliminary approval in December 2019.

The defendants in the TikTok class action lawsuit have denied and do not admit to any wrongdoing by settling the claims against them.

“Plaintiffs believe that this settlement — which partly arises out of COPPA violations and involves the unlawful collection of children’s personally identifiable information and/or viewing data without parental consent — represents the first settlement of its kind,” the plaintiffs noted in their TikTok class action settlement motion.

Under the settlement, Class Members will be able to receive payments estimated to be between $10 and $15. Exact payments amount will depend on the number of claims filed.

The deadline for exclusion and objection has passed.

The final approval hearing for the settlement is scheduled for Aug. 31, 2021.

In order to benefit from the settlement, Class Members need to file a valid claim form by July 24, 2021.

Who’s Eligible

All people who registered for or used TikTok, or its predecessor Musical.ly, while under the age of 13, along with these individuals’ parents.

Potential Award

Between $10 and $15.

Exact payment amounts will depend on the number of claims filed and the net settlement fund remaining after awards, costs, and fees are deducted.

    The appeal on this case has been dismissed by the Court. Settlement payments will be disbursed in the next 2-3 weeks.

    Did anybody get this payment or still waiting??
