A class action lawsuit alleging GM sold defective Vortec engines that suffer from excessive oil consumption will continue in Oregon after defeating a dismissal attempt by the automaker in Oregon federal court.  

Lead plaintiff, William Martell, filed the GM engine class action lawsuit in Oregon federal court in February 2020. He claimed that his 2011 Chevy Silverado suffered from excessive oil consumption caused by defects in the Vortec engine.  

Martell claimed the following vehicles were equipped with a defective GM engine: 

  • 2010–2014 Chevrolet Avalanche 
  • 2010–2013 Chevrolet Silverado 
  • 2010–2014 Chevrolet Suburban 
  • 2010–2014 Chevrolet Tahoe 
  • 2010–2013 GMC Sierra 
  • 2010–2014 GMC Yukon 
  • 2010–2014 GMC Yukon XL 

GM urged the court to toss the class action lawsuit, contending that the automaker had not breached its express warranty to Martell and others who owned vehicles equipped with Vortec engines, along with seeking dismissal of state law and fraud claims.  

U.S. District Judge Michael H. Simon rejected GM’s attempt to dodge the breach of warranty, as well as fraudulent concealment, and claims under Oregon state consumer protection laws.  

This is far from the only class action lawsuit lodged against GM claiming the Vortec engine is defective. The carmaker faces a class action in Michigan alleging that GMC and Chevy vehicles equipped with a Generation IV Vortec 5300 run through excessive amounts of oil. A West Virginia plaintiff also filed a class action lawsuit claiming GM knows about the faulty system that burns off extraordinary amounts of oil, causing engine failures and misfires, but allegedly continues selling vehicles despite the defective Vortec engine.

    I have a 2012 Chevrolet Suburban with the 5.3L engine. It started running rough and died. Took in to have it worked on and was informed of the problems with this engine, and that the symptoms and the final condition were in line with the Class Action currently underway.

      I have a 2017 Chevy Silverado 5.3 1500 and my transmission blew out with only 60k miles, cost me over 6k to fix

    I have a 2011 Silverado that has the #1 and #7 spark plug foul out about every 15000 miles. I also about 2 or 3 quarts low on every oil change and change my oil when it hit 50% on the dash. Have owned it since 60000 miles and had 175000 on it now just a pain to keep checking this all the time.

      Did anyone have a failed lifter & VLOM-Valve Lifter Oil Manifold in their 2013 Chevy Silverado that was the result of this particular defect in these Chevy vehicles with the Vortec Engines?

      Recently had a Valve lifter (Cylinder 7 fail) and Chevy claimed 1st point of failure was the VLOM (Valve lifter oil manifold) Oil levels were good, no warning-no check engine light just suddenly began knocking when exiting off the I-95 Ramp! Immediately pulled off to the side at the bottom of the exit ramp and had our truck Immediately towed to the Chevy Dealership. Cost us $5,800. in repairs in November 2022. Wondering if this could be the actual cause of our needed repairs 🤔 Though I’ve also been reading certain years had several issues with a manufacturer defect in their Lifters 🤔

    I have a 2013 Chevy Tahoe with 5.3L engine 113k miles and have maintained religiously. In between oil changes, typically 5-10k miles the dash lights lit up showing the stabilizer and and traction controls were not working. The oil level was suddenly at low and one of the spark plugs had fouled with oil. This is not normal and I can no longer trust the engine. The mechanic said it’s probably bad valves and I would need to go to the dealer for engine repairs. I should be eligible for class action suit regarding failing engine for 2013 Chevrolet Tahoe

    I’ve had 2 engines go out on my 2012 Chevy Silverado 5.3 and my 3rd just went out on me because of this issue. My first engine went out on me before it hit 100k miles and I bought it with only 30k miles

    Please add me to this Class action suit. I have a 2013 Silverado w/ 5.3 L V8 Vortex. I started getting random Misfire Check Engine light Warnings last month along with Traction Control/Stability Warnings on dashboard. Took to dealer, charged me $1400, pulled out of parking about 10 miles from Dealership and CK engine light came on again. My issue is not as much about Oil Burning as it is lifters though I did notice one time, It had burned a large qty of oil between oil Changes to the point engine was almost out of oil but for a small amount just readable and was shocked. Truck is at dealership now had it towed due to Lifter issue causing Engine Misfire.
