San Pellegrino Lemon Class Action Lawsuit Overview:

A New Yorker says the lemon flavor of San Pellegrino sparkling mineral water is falsely advertised using a “yellow-tinted” bottle and misleading labeling to trick consumers into thinking the product contains more lemons, in a class action lawsuit.
Maritza Angeles, the lead plaintiff of the class action lawsuit, says she bought the S. Pellegrino Essenza – Lemon & Lemon Zest water product expecting it to contain more lemon ingredients than it actually does due to its name and yellow tinted packaging.
Angeles wants to represent New York, Iowa, and Arkansas consumers who purchased the yellow-tinted San Pellegrino lemon drink. She says the beverage maker, BlueTriton Brands, deliberately mislabeled the product, tricking consumers into paying a premium for the sparkling water.
San Pellegrino Lemon Label Dishonest About Ingredients
Angeles takes issue with the San Pellegrino lemon water’s labeling and subsequent lack of “an appreciable amount of lemon,” which court documents define as “ an amount sufficient so that all the lemon taste comes from lemons.”
Just by its name, the S. Pellegrino Essenza – Lemon & Lemon Zest indicates a product with lemon ingredients, says the plaintiff.
Further, the bottle is also wrapped in yellow cellophane, which gives the appearance of a more yellow drink than what’s inside. The class action lawsuit claims this violates federal and state food labeling regulations by being purposely deceptive and misleading.
In truth, the product’s ingredients do not include lemon or lemon flavors, but rather “natural flavors,” which “consists of flavor compounds from some lemon, which imitates the taste provided by lemons,” alleges the class action lawsuit.
The class action lawsuit maintains that Angeles would not have bought the water if she had known the truth about its ingredients, and that the product is worth less than what she paid. She argues that, thanks to its misleading labeling, BlueTriton Brands sold more of the product and at higher prices, resulting in additional profits at the expense of consumers.
The class action lawsuit seeks a directive for BlueTriton Brands to correct its allegedly misleading practices, a directive to refrain from such practices, repayment of the company’s unfair gains, monetary, statutory, and/or punitive damages, and other relief.
