Canadian consumers who purchased lithium ion battery products between 2000 and 2012 may be eligible to claim $20 without proof of purchase thanks to a $21.3 million class action settlement.
The Class includes anyone in Canada who purchased lithium ion batteries or lithium ion battery products between Jan. 1, 2000, and Jan. 1, 2012.
Lithium ion batteries are rechargeable batteries used in various electronics.
Lithium ion battery products are items such as laptops, e-book readers, mp3 players, GPS units, and cellphones and smartphones (excluding those sold as part of a service contract).
Class action lawsuits in British Columbia, Ontario, and Quebec alleged several lithium ion battery manufacturers — including major electronics brands such as Samsung, Sony, Panasonic, and others — worked together to fix prices on the product, resulting in higher prices for consumers.
The defendants deny all allegations of wrongdoing.
Lithium Ion Batteries Settlement Benefits
Class Members can claim with respect to all lithium ion batteries or lithium ion battery products they purchased, regardless of the manufacturer or brand.
Those who file undocumented claims will receive a payment of $20.
Class Members wishing to receive more than $20 must provide proof of purchase.
The net amount remaining in the lithium ion battery product settlement fund after undocumented claims are paid will be distributed proportionately based on the value of each Class Member’s point total compared to the value of all Class members’ point totals.
Points will be calculated based on the Class Member’s lithium ion batteries or lithium ion battery product purchases and on the categorization of that Class Member.
The point values are as follows:
- 6 points: notebook computer or replacement battery, laptop computer or replacement battery
- 2 points: handheld video player or replacement battery pack
- 1 point: tablet computer or replacement battery, e-book reader or replacement battery, MP3 player or replacement battery pack, personal digital assistant or replacement battery pack, handheld GPS or replacement battery pack, and cellphone/smartphone or replacement battery pack (excluding phones acquired as part of a cellphone service contract)
Class Members will be grouped according to the following purchaser categories:
- Direct Purchaser End Users: Class Members who purchased lithium ion batteries or lithium ion battery products for their own use — not for commercial resale — directly from one of the defendants or an entity related to a defendant. These purchases will be valued at 100 percent.
- Direct Purchaser Resellers: Class Members who purchased lithium ion batteries or lithium ion battery products for commercial resale directly from a defendant or an entity related to a defendant. These purchases will be valued at 25 percent.
- Other Purchaser End Users: Class Members who purchased lithium ion batteries or lithium ion battery products for their use and not for commercial resale from an entity that is not one of the defendants or related to a defendant, including a non-defendant manufacturer. These purchases will be valued at 80 percent.
- Other Purchaser Resellers: Class Members who purchased lithium ion batteries or lithium ion battery products for commercial resale from an entity that is not one of the defendants or related to a defendant, including a non-defendant manufacturer. These purchases will be valued at 15 percent.
The deadline to submit a claim is Dec. 17, 2021.
Who’s Eligible
Anyone in Canada who purchased lithium ion batteries or lithium ion battery products between Jan. 1, 2000, and Jan. 1, 2012.
Potential Award
$20.
Class Members who file undocumented claims will receive a payment of $20.
Those wishing to receive more than $20 must provide proof of purchase.
Proof of Purchase
Where possible, Class Members will be able to rely on the defendants’ sales records to establish their purchases. When possible, this information will be provided via email or letter by the administrator and will be pre-populated on the online claims portal. No further proof of purchase will be required.
Where sales data is not available and/or a Class Member claims for purchases of lithium ion batteries or lithium ion battery products in addition to those substantiated by the defendants’ data, the Class Member must provide proof of purchase, such as invoices, receipts, delivery or packing slips, purchase records, or historical accounting records; or a declaration attesting to the units purchased, along with substantiating documentation acceptable to the administrator.
Where a Settlement Class Member does not have all purchase records for the period between Jan. 1, 2000, and Jan. 1, 2012, they can extrapolate their lithium ion batteries or lithium ion battery products purchases based on existing purchase records between those dates or after that period. The Class Member must provide the basis of the extrapolation and proof they were fully operational during the period in which the purchases are being extrapolated.

I have bought MANY of these batteries over the years. Defiantly add me to the list please.
I have purchased some of these lithium ion battery products between 2000 and 2012 and would like to be added to the class action lawsuit.
I have bought many of these products, no proof. Batteries are never under warrantee. Please include me.

I purchased first viao in 2004 from Sony store at Oakridge Mall Vancouver BC then get new battery replaced in 2010 It was not good. I purchased New Vaio from London Drugs store, Vancouver BC in 2011 and still have it but not using for 2 years due to Covid 19 I cannot cross the USA border Its at my cottage in USA.
