Residents of Madison Heights, Michigan, who paid the city stormwater charges may be eligible to benefit from a $2.6 million class action lawsuit settlement.
The Class includes anyone who owned or resided at a property and incurred or paid stormwater charges to Madison Heights between July 1, 2016, and June 30, 2021.Â
Plaintiffs in a class action lawsuit had challenged the city’s mandatory stormwater service charge, arguing the charge is not a proper use fee, but rather a wrongfully imposed tax.
Madison Heights has denied all allegations of wrongdoing, and the Court has not ruled in favor of either party in this case.
The city had a population of nearly 30,000 as of July 1, 2019, according to the United States Census Bureau.
Class Members who are current water, sewer, or stormwater customers of the city will have their account credited with a proportionate share of the settlement fund.
Any Class Members who have unpaid balances for water, sewer, or stormwater charges that were more than 30 days past due as of June 30, 2021, will have their credits reduced by the amount of that past-due balance.
Those who are no longer water, sewer, or stormwater customers of Madison Heights and wish to receive a cash refund if they qualify must submit a written claim form.
Each Class Member’s payment will be determined by calculating the total amount of charges they paid during the Class Period and dividing that number by the total amount of charges Madison Heights collected from Class Members during that period. The resulting amount will then be multiplied by the amount of the net settlement fund.
A final approval hearing in the Madison Heights stormwater settlement is scheduled for Dec. 1, 2021.
The deadline to opt out of or object to the settlement is Oct. 2, 2021.
The claim deadline is also Oct. 2, 2021.
