GM Canada Airbag Defect Class Action Lawsuit Overview: 

  • Who: William Arthur Baldridge filed a class action lawsuit against GM Canada.
  • Why: Plaintiff claims certain vehicles manufactured by GM Canada contain airbag control units that are defective due to being misprogrammed.
  • Where: The class action lawsuit was filed in the Supreme Court of British Columbia.

Certain vehicles manufactured by GM Canada contain defective airbag control units that cause seatbelt pretensioners and airbags to fail, a new class action lawsuit alleges. 

Plaintiff William Arthur Baldridge claims his 2005 Chevrolet Silverado 2500 has lost value because of a defective airbag control unit module which fails to properly deploy a vehicle’s airbags and tense it’s seatbelts in the event of a crash, reports CarComplaints

Baldridge — who says he hasn’t personally suffered any airbag or seatbelt failures — wants to represent a nationwide Class of consumers outside of the Province of Quebec who have purchased an affected GM vehicle. 

The affected GM vehicles span two decades and include certain GMC, Chevrolet, Buick, Cadillac, and Isuzu vehicles. 

Defect Causes Airbags, Seatbelts to Fail, Says GM Canada Class Action

The GM vehicles airbags and seatbelt pretensioners fail during accidents because of a software defect calibrated into the airbag control unit, according to the class action lawsuit. 

Baldridge claims the airbag control module was programmed to keep airbags and pretensioners from deploying after 45 milliseconds, even if it continues receiving crash information beyond that time, reports CarComplaints.com. 

A frontal car accident generally lasts between 80-150 milliseconds, according to the class action lawsuit.

Baldridge alleges GM knows about the defect but conceals it and claims the vehicles are safe — despite hundreds of consumer complaints related to the issue — so it won’t have to undergo an expensive recall campaign. 

GM Canada recalled more than 470,000 of its trucks and SUVs in February to replace defective inflators in its Takata-manufactured airbags

A class action lawsuit was filed last month in the US that alleged GM and Chrysler concealed from consumers that Joyson-brand airbags installed in certain trucks were prone to explosion

    Our seatbelts are defective on our 1989 c4 corvette and GM and GM dealership is unwilling to honor the recall and Transport Canada is unwilling to assist in rectifying this issue. We never recieved that recall notice for seatbelts on our car, and not once did the GM dealership we had our car serviced at disclose this major safety recall defect and we even paid extra for 32 point safety inspections. Recently another helpfull c4 Vette owner provided me with a copy of that recall letter a few weeks ago. The recall is for seatbelt extractors for both driver and passenger side of these vehicles C4 Corvette model year from 1984 -1991 and 10,000 units were affected and GMs Recall campain was not as affective as we were led to believe, so within the letter it states if seatbelt issue occurs that they will be replaced in the future and keep the letter in the event occurs again the belts will be replaced but, still GM is refusing to follow what it states in the recall letter and still to this day we never recieved that recall from the manufacturer GM. Recall Campaign number is 91C25 and 91C26 which corresponds to the driver and passenger side of these cars, also there is a GM recall procedure manual in replacing these belts and to affix a recall campaign sticker with the recall number on both the left and right side of the cars radiator shroud, if the defective seatbelt(s) have not been replaced could endanger the lives of both driver and passenger of these vehicles. This recall can be found on the NHTSA and Transport Canada but i would rely more on the the American NHTSA site than Transport Canada website. Also we have all documents and correspondences with GMC and GM Customer care and Transport Canada, as well as a video clip of driver side seatbelt seizing up and a letter from Transport Canada stating they are unwilling to get involved even though they take vehicle recalls in terms of safety seriously but willfully refuse to step in. Also Transport Canada sued Hyundai for failure to send out recall notices within 60 days to owners of Hyundai cars, and in our case well beyond the 60 period in accordance to the recall act and Hyundai was only 2 yrs late but in our case well beyond 3 decades. Hyundai was sued for over 300,000 dollars, and yet all we want is seatbelts so we can drive our car again and safely and we know that a lot of these C4 corvette owners of the 1984 -1991 model year are not aware as they never recieved that recall notice for the seatbelt(s) from General Motors

    Mine seems different as I had air bags deploy for no reason at all driving down my driveway
    Gmc sent investigators twice to my house to look over truck first time investigators spent a day at my home going over truck and said they could find no reason for air bags deploying then second time they took my truck from home to a shop where they said they were going to remove seat but never did that and returned with that gm was not at fault because truck was in a near roll over incident.
    Which I know is ridiculous because I was in driveway and even after air bags deployed scared the hell out of me I actually exited vehicle then realized what happened jumped back in vehicle to stop in from rolling away down my driveway.
    I believe they just figured I would go away because running my win company was too busy to ever deal with them but whole thing is pissing me off because if I had been on highway which I was seconds from I could have been killed and not just a sore shoulder.
    Any help with this would be much appreciated

    I was involved in a crash 2 weeks ago where a driver ran a red light and T boned me, knocking me into another lane causing me to be hit again. I have sustained concussion, whiplash and nerve damage in my shoulder/arm. My airbags failed to deploy. GM are inspecting my car and pulling the data so they can carry out an investigation.

    I was in a accident march 11th 2021 in my 2010 chevy traverse and the airbags did not deploy i luckily only suffered whiplash but could have been seriously injured or could have died

    I was in a car accident in 2011. Where the air bags did not deploy , I was injured and still am today.

    I was in a single vehicle accident in July 2021 in a 2008 GMC Sierra where both airbags did not deploy and I was injured, and spent time in the hospital afterwards and missed time off work, due to my injuries I still feel discomfort today
