Systemic Racism Class Action Lawsuit Overview: 

  • Who: More than 520 former Black federal workers filed a class action lawsuit against the Canadian government.

The newly-formed Canadian government will need to decide the next steps it wants to take in the face of a $900 million class action lawsuit filed by more than 520 current and former Black public servants who claim they were subjected to systemic racism

Prime Minister Justin Trudeau — who retained his position this week despite failing to secure enough seats to form a majority government — must assess how to address a class action lawsuit filed in December 2020 that has grown significantly from its 12 initial claimants. 

New Government Faces Claims of Systemic Racism By Federal Employees

Plaintiffs could end up representing more than 300,000 former Black federal employees who have experienced discrimination and racism during their employment since 1970, according to Global Government Forum

Trudeau acknowledged in June of last year that institutionalized racism exists in Canada’s public sector of employment. 

“Systemic racism is an issue right across the country, in all our institutions, including in all our police forces, including in the RCMP. That’s what systemic racism is,” the Prime Minister said at the time during an Ottawa news conference, reports the CBC

Trudeau pledged during his re-election campaign to establish a fund for Black Canadians who work in the country’s public service industry, though the government has held fast that there are systems already in place to help Black workers, according to Global Government Forum. 

Plaintiffs want Trudeau to set up a $900 million fund for Black employees — to rectify current and past harm — along with the formation of a Black Equity Commission, which would investigate challenges facing Black workers, implement solutions, and hold people accountable.

In addition, plaintiffs are asking for a policy put in place to ensure the number of Black federal employees is equal to that of the general population, along with a formal apology from Trudeau.
