B.C. Abuse Compensation Class Action Lawsuit Overview: 

  • Who: Two B.C. women filed a class action lawsuit against the Ministry of Justice, the Ministry of Child Development and Family, the Workers Compensation Board, and the Public Guardian and Trustee.
  • Why: Plaintiffs claim they were victims of abuse while under government care as youth and were not told they were entitled to compensation.
  • Where: The class action lawsuit was certified by a judge in the B.C. Supreme Court.

A class action lawsuit filed by two B.C. women who claim they were not informed they were entitled to compensation after being abused as minors while in government care was certified by a B.C. Supreme Court judge on Sept. 17. 

The class action lawsuit targets public institutions and provincial ministries who plaintiffs claim failed to protect vulnerable youth in their care or inform them of their rights. 

Plaintiffs K.S. and M.C. want to represent themselves and a Class of anyone who suffered injury because of crime or tort either before or while under the care of the B.C. child welfare system between July 1, 1972 and Sept. 17, 2021. 

The Ministry of Justice, the Ministry of Child Development and Family (MCDF), the Workers Compensation Board, and the Public Guardian and Trustee are all named as defendants in the class action lawsuit. 

In New Class Action, Plaintiffs Claim They Were Never Informed of Their Rights for Compensation After Being Assaulted While Under Government Care

K.S. claims she was never told she could be eligible for compensation after she was assaulted by a classmate at the age of 17 while under government care.

“At no time prior to this litigation did those social workers or anyone else inform K.S. that as a result of these events, she could make claims for benefits or compensation under crime victim legislation or through a civil suit for damages,” the class action lawsuit states, as reported by the CBC

K.S. further alleges the government never informed her she could also be eligible for counseling or other benefits on account of sexual abuse she endured when she was a child prior to entering government care. 

M.C. alleges that, despite being the victim of a sexual abuse when she was 14, the MCDF never told het she was entitled to anything despite being aware of the crime. 

Crime victims in B.C. are entitled to benefits to help compensate them for what they endured and to help them move forward with their lives, reports the CBC. 

The B.C. government was also the target of a separate class action lawsuit filed in February by the Canadian Society for the Advancement of Science in Public Policy, which alleged the government harmed the public by responding excessively to the COVID-19 pandemic

    Please contact me by email as I was placed in care when I was 12 where I am as not informed of any rights, or compensation, in fact after I ran away from the foster home I was detained in a drunk tank at London Police and when I was finally released into my foster parents care he charged me 200.00 to drive me back to Mc Kays corners , just outside of Chatham , to return back to the foster home. After several days of sitting at a kitchen table I was allowed to return home to my parents home. Please contact me at readyandnot@yahoo.com

    Yes, I was abused and the man was charged later when I become an adult this was in Terrace Bc. I asked they said I wasn’t able to get anything also when My ex beat me for ten years no help was available I got out on my own

    My daughter was taken from me because I was not dealing with the abuse she suffered by my mothers husband and one of the conditions in having her returned was to follow through with charges then while in there care she was sexually abused and witnessed the other child who was abusing her beaten bad then returned to me without even telling me she had been abused which cost us to get a poor outcome and take a plea in the abuse she had already suffered because she was confusing the abuse in care and the other abuse if we would have known this our lawyer could have handled the other case different

      Yes I was a victim of abipuse while in government care yes st grouphome used to make us strip down to our under wear no shirt and make ius stay naked in our room s for twent6 four to fourty right hours and male staff would check on us and deliver meals ect I consider that sexual abuse THAT WAS IN BC 1777YEW ST GROUP HOME prince George bc

    I was in CAS care from 1946 through 1966 in Ontario and suffered sexual abuse from all foster fathers and physical abuse from foster mother. Tried to tell and was told I was lying and just trying to get attention. No one ever told me there was help available.

    I was in care in the 70’s and 80’s. I was being abused while I was in care and was never told who I could talk to about it. This happened in Alberta

    My common law was locked up while in care and hurt his arm too there where nuns involved

      In th3 nineties I was in yew st group home and they used to make us strip down to just underwear and be like THAT WHEN WE RAN AWAY WE WOULD HAVE TO STAY LIKE THAT FOR TWENTY FOUR TO FOURTY EIHHT HOURS SOMETIMES LONGER AND MALE STAFF WOULD XHECK ON USNANẞ BRIN US MEALS ECT THt consequence was for running away.it was in yew st group home in prinçe George BC Canada
