FedEx, Overnight Shipping & Class Action Lawsuit

FedEx Overnight Shipping Class Action Lawsuit Overview: 

  • Who: Jane Zupetz filed a class action lawsuit against FedEx Office and Print Services Inc. 
  • Why: Zupetz claims FedEx took four days to deliver her letter even though she paid more for overnight delivery.
  • Where: The class action lawsuit, which has been dismissed, was filed in Kentucky district court.

  • This case was dismissed without prejudice Nov. 5, 2021.

FedEx fails to always ship packages and letters the next day as promised, despite charging more for its overnight delivery service, a new class action lawsuit alleges.

Plaintiff Jane Zupetz claims FedEx breaks its promise to customers and misrepresents its services by not actually shipping parcels as advertised. 

Zupetz wants to represent a Class of Kentucky consumers who paid for FedEx overnight delivery services but did not have their letter or package shipped in a timely manner. 

Zupetz says she paid FedEx $39.60 to deliver a letter for her with “standard overnight” shipping.

FedEx did not actually ship the letter out until four days later, breaching their agreement, the class action lawsuit alleges. 

Zupetz claims FedEx refused to offer her a refund for the shipping cost, and argues she would have simply paid 60 cents for a stamp had she known her letter was not actually going to be delivered the next day. 

Zupetz is asking for a jury trial and requesting compensatory damages for herself and all Class Members. 

A similar class action lawsuit was filed last month by a FedEx customer in Tennessee who claimed the company failed to timely deliver a package and refused to issue a refund

    I was supposed to receive vital medication from ExpressScripts, they shipped them overnight with FedEx on Friday. The package made it to Orlando by 6am Saturday, now it’s 5pm Monday, I am in dire straights. Just got text “delayed”. They cause harm with their lies. Orlando is 25mins from me !

    I just paid $156 for standard overnight and the package was not delivered. It is now the second day, and I received an email the package is out for delivery today – a day late. Please add me.

    I’m hoping that there is a class action lawsuit coming soon against Fed Ex. Every time I ship or receive a shipment with Fed Ex my package is late or lost. I have a current dispute on a lost package that was shipped over night. I have not received any reimbursement for the shipping or the lost contents. Today I had 2 more shipments that are delayed. Their customer service is horrible and it’s very hard to file a claim. Not one time have I won my claim or ever seen any sort of reimbursement.

    I have been with Fed Ex for over 24+ years and always had great service until this new policy change came out.
    I had a package that I needed shipped to me from my vendor using my account# for standard overnight and it was not delivered per the airway bill. I tracked the package and it said it would be delivered on time then after the paid for delivery date it said it would be delivered the following day.
    To make a long story short, they would not allow me to speak to a supervisor, customer service said they don’t want to deal with it because there is nothing they can do. The driver, which was not my regular driver as I asked him the next day when he delivered why he didn’t leave on the front porch, said he wasn’t on the truck that day. The driver listed business closed / no adult available….total BS, it was a residential house and office 3 feet from front door.
    Customer service stated they placed a complaint for a credit and it was denied, never received the email they said I would get to follow what the outcome was.
    This has happened more times than I can remember over the years. They used to at least give a partial credit or refund.
    I AM DONE WITH FED EX, going to UPS full time now for all my shipping needs, and they are cheaper than fed ex!
    I would love to be added to a class action!
