Whirlpool Leaky Dishwasher Class Action Settlement Overview:
- Who: Whirlpool Corp. has reached a class action settlement with consumers that is worth between $15.71 and $21.33 million.
- Why: Consumers claimed Whirlpool sold dishwashers containing a defect that caused them to leak and the appliance maker has proposed to pay each Class Member up to $255 for repairs and replacements.
- Where: The class action settlement is pending in Minnesota federal court.
Whirlpool Corp. has reached a class action settlement that will reimburse consumers who claim they were sold dishwashers with a defective part that caused them to leak.
Consumers will be reimbursed up to $225 for repairs or a replacement they can show they had to pay out-of-pocket for due to an allegedly defective sump assembly, per the class action settlement agreement.
The settlement, reached late last week, has a total estimated value of between $15.71 million to $21.33 million and includes as much as $1.5 million for attorney fees, according to court documents.
Whirlpool Class Action Settlement Covers Kenmore, KitchenAid, Jenn-Air, Amana, Other Brands
Plaintiffs Elizabeth Cleveland, Christopher Redmon, Amy Larchuk, Dhaval Shah, and Thomas McCormick claimed in four separate class action lawsuits lodged against Whirlpool that a defective seal in the dishwashers’ sump assembly was the cause of the leakage.
The allegedly defective dishwashers were manufactured between January 2010 and December 2017 and included certain Kenmore, KitchenAid, Ikea, Jenn-Air, Whirlpool, and Amana brands.
The dishwashers eligible for the reimbursement must include the alleged defect and have been manufactured within eight years of the repair or replacement taking place.
Plaintiffs claimed Whirlpool has touted for years that its dishwashers — which cost between $500 and $700 — are durable and have an expected life-span of 10 years, reports Law360.
Despite these boasts, Whirlpool has known about the defect while simultaneously denying its existence for the past eight years, plaintiffs alleged.
Whirlpool is not acknowledging its dishwashers have a defect by agreeing to the settlement, but rather said it “believes that the comprehensive resolution of the issues in the Lawsuits as provided in this Agreement will avoid the substantial costs and disruptions of continued litigation.”
Whirlpool and Sears paid between $1.5 and $2 million in a class action settlement to end similar defective dishwasher claims in 2015.
