Discount Tire Estimate Class Action Lawsuit Overview: 

  • Who: A Florida woman has lodged a class action lawsuit against Discount Tire.
  • Why: The plaintiff alleges Discount Tire fails to provide its customers with written estimates before the work is performed for repairs exceeding $100.00, violating state law. 
  • Where: The class action lawsuit is pending in Florida federal court.

Discount Tire Co. does not provide customers a written estimate prior to repairs, a violation of Florida state law, a new class action lodged in federal court Wednesday alleges.

Lead plaintiff Hillary Ring says in her lawsuit that, instead, it is common practice for sales representatives to confer with each customer, and, once the tires are chosen, the representatives enter the information into a computer. At this point, the customer is told the total price of the tire installation but receives no written estimate. 

Discount Tire obtains payment in full of the pending repairs and directs customers to a waiting area, alleges Ring. After the repairs are performed, the representative calls the customer back to the sales counter, and at that time the representative finally prints the repair invoice, folds it, places it into an envelope, and hands it to the customer along with the keys to the customer’s vehicle.

Ring points out that, during this process, Discount Tire does not obtain a customer signature or checkmark indicating the selected repair options — all required under Florida state consumer protection law. 

“The harm that occurs to Discount Tire customers as a result of the tactic described above is that customers are unable to review the costs being charged or to make meaningful choices for products that Discount Tire regularly adds to the invoices without customer approval,” the lawsuit states. 

Discount Tire Customer Says Surprise Fees Added to Bill in Class Action Lawsuit

Ring says during her visit to Discount Tire, she was charged an “Installation & Life of Tire Maintenance” fee of $22 per tire without her approval.

The plaintiff wants to represent consumers in Florida who made a purchase from Discount Tires for more than $100 but were not provided a written estimate prior to the repair. She is seeking judgment against Discount Tire for damages, along with interest both pre- and post-judgment, costs and attorney fees, and demands trial by jury.

In recent years, Discount Tire faced a wage and hour lawsuit by workers who claimed that they were wrongfully denied overtime pay.
